| 摘 要： | “人治”与“法治”之争是辛亥革命不彻底而留下的后遗症 ,它始终贯彻于民初的政治生活之中 ,并引发出许多惊心动魄的历史场面 ,二次革命 ,护国运动、护法斗争无一不是这种斗争发展的最高表现 ,从而出现了民初政局动荡不定 ,复辟与反复辟、造法与毁法屡见不鲜的奇特景观。

| Abstract: | The struggle between the principles of "rule by authority" and "rule by law" was the sequels left over by the unthorough 1911 Revolution. The struggle went on throughout the political life during the beginning period of the republic (1912-1949). History witnessed many soul-stirring scenes. The Second Revolution (1913), the campaign defending the republic and the campaign defending the constitution were the climax of such struggles. Such unique scenes as restoration of monarchy and struggles against it , and law-making and defiance of law in history showed the political disturbance of that period. |
