| 摘 要： | 知识产权的专有性或者排他性，知识产权人就可以通过其智力成果在一个有限的时间和一定地域内就某种产品的生产或者销售取得垄断地位，但是知识产权的滥用阻碍科技进步，所以本文拟在知识产权法与反垄断法之间作出权衡．将知识产权纳入反垄断法的调控之下。

| Abstract: | Knowledge property right has nature of monopoly and exclusion .Knowledge property right can gain monopoly position by means of producing or selling its intelligent outcomes in some limited times and in a special region,but an abuse of knowledge property right may hinder science and technology from making progress.So in this article,I try to weigh Knowledge Property Right Law against Antimonopoly Law,and attempt to bring knowledge property right into control of Antimonopoly Law. |
