| 摘 要： | 基于人身危险性的特殊预防目的而对累犯进行从重处罚具有必要性，但从重处罚不应突破报应刑的限制，否则违背罪刑法定等原则，不符合保障个人权利的刑法发展潮流。报应刑是量刑阶段的主要依据，从轻、减轻以及免除情节等特殊预防情节辅助之；预防刑为刑罚执行阶段的主要依据。

A New Explanation of Heavier Punishment to Recidivist |

| Abstract: | For the purpose of the special prevention, it is necessary to punish the recidivist more heavily, but the heavier punishment should not exceed the limit of the retributive punishment. Otherwise, it will violate the prin- ciple of statutory crime and penalty, and doesn＇ t accord with the modem trend of protecting personal right in crimi- nal law. The base in penalty measurement is the criminal responsibility, the plots of special prevention, such as lighter punishment or exemption from punishment, can help to determine the penalty; and the preventive punish- ment is the mainstay in penalty execution. |
