| 摘 要： | 《民办教育法》及其实施条例、教育部《关于规范并加强普通高校以新的机制和模式试办独立学院管理的若干意见》是规范我国公办学校举办民办学校的主要政策。这些政策促进了我国公办学校办学模式的探索，但大量公办高校举办独立学院使得本来处境艰难的民办学校处于更加激烈的竞争之中，不利于民办教育的发展。相关政策有必要进行调整，思路是明确公共教育资源的投入教育层次和教育类型，保证教育发展符合国家的整体政策导向，实现公办教育与民办教育之间的有效融通。

| Abstract: | Law of Private Education and its implementation regulation,and Stipulation on Regulation and Improvement of Administration of General Education Institutes in Their Provisional Sponsor of Independent Schools Based on New Institutions and Mode issued by Ministry of Education of China stipulate that government-run institutes can sponsor private education institutes.
