| 摘 要： | 工伤认定是给付工伤待遇的前置程序，工伤认定申请时效是工伤申请主体申请工伤的期限，超过其期限。有关主体便丧失工伤申请的权利。因而，工伤认定时效的设置合理与否关系到工伤职工切身利益的维护，而我国工伤认定时效存在诸多的问题，首先对其性质做出界定，然后对其起算点、中止、中断等问题作出新的规定，以符合工伤立法的目的和宗旨。

In case the application should exceed the limitation, the applicant will be deprived of the right.
