| 摘 要： | 中国古代很早即有契约,但契约主体的自由意志受到扼制以至泯灭。中国古代一直缺乏现代契约精神;古代契约不是自由意志的结果,反而表现出浓厚的身份性。本文通过对古代契约身份特点的分析,希望人们正确认识古代契约制度。在现代市场经济条件下,为弘扬现代契约精神,在中国需要来一次真正的从身份到契约的运动。

| Abstract: | Contract came into being as early as in ancient China, but the freedom of both parties of contract wererestrained or even destroyed at that time. Ancient contract, embodied by social status rather than by freedom, lacked thespirit of today. Based on the analysis of status feature, this paper calls for a movement of contract highlighted by modernspirit. |
