| 摘 要： | 当前，我国解决专利利益冲突的法律法规相对贫乏，司法解决仍是一条重要途径。而在司法解决的过程中，法官必然通过对权利要求进行解释这一方式对冲突着的权利边界进行重新界定。其解释的过程也是对冲突着的利益进行衡量和取舍的过程，对专利利益格局的调整有着重大影响。因此，分析权利要求解释原则，理顺各原则的适用规则，对专利利益冲突的顺利解决至关重要。

| Abstract: | At present, laws and regulations which can be used to resolve patent conflicts of interests in China are relatively deficient, and judicial settlement is still an important way. In this process, inevitably, judges will redefine the conflicting claim boundaries through explaining the claim. At the same time, the process is also a process in which the conflicting interests are measured and selected, which has a major impact on the adjustment of the interests. Therefore, to analyze principles applied in the claim explanation and the proper application of each principle is essential to successful resolution of conflicts of interests. |
