| 摘 要： | 我国是实行制定法国家 ,制定法自身具有滞后性、原则性等缺点 ,因此在司法实践中缺乏灵活性。在法律实践中 ,判例法及其价值已经被越来越多的法律界人士所关注 ,并将判例法方法论不同程度地引入本国法律制度及法学研究中。我国也应借鉴判例法 ,完善我国法律制度

| Abstract: | Statute law is exercised in China. In legal practice it lacks in flexibility owing to its own properties of lag and principle. On the other hand, men of law pay more and more attention to case law and its value and introduce its methodolgy into their own counties' legal system and research. We should use case law for reference to improve China's legal system. |
