| 摘 要： | 违宪审查制度的构建是现阶段我国宪政制度的重点与难点。建立以宪法法院为主体的违宪审查制度是法治国之最佳模式。宪法法院是最高司法机构,其宪法地位与全国人大常委会平行,仅低于全国人民代表大会。并阐述了宪法法院与国家各机关的权力配置:宪法法院与全国人民代表大会及其全国人大常务委员会的权力关系;宪法法院与国务院的权力关系;宪法法院与最高人民法院的权力关系;宪法法院与最高人民检察院的权力关系。

| Abstract: | The construction of unconstitutional reviewing system is a key point and also a difficult point in constitutional government in our country at present stage.With the constitution court as its corpus,the unconstitutional reviewing system is the best mode of ruling a country by law.The constitution court is the final judicial organization,and its constitution position is paralleled with the standing committee of National People's Congress,only lower than National People's Congress.The power structures between constitution court and other institutions are expounded as followed:the power relation between Constitution court and the National People's Congress and the Standing Committee of the National People's Congress,the power relation between Constitution Court and the State Council,the power relation between Constitution Court and the People's Supreme Court and the power relation between Constitution court and the People's Supreme Procuratorate. |
