| 摘 要： | 我国的亲亲相隐制度源于儒家思想,其蕴涵了现代刑法的基本价值:满足了人性的根本需求;合理解决了道德义务和法律义务冲突;暗合了现代刑法中的期待可能性思想。亲亲相隐制度顺应了构建和谐社会之需要。解读亲亲相隐制度的合理价值蕴涵,并借鉴国外刑事法律的相关规定,重构亲亲相隐制度具有重大现实意义。

| Abstract: | Kin Concealment System originates from Confucius,and it has contained the modern criminal law basic value: met the basic need of human nature,reasonably solved the moral duty and the legal duty conflict and implied the thought of anticipated possibility in the modern criminal law.Referring to foreign criminal law,we should reconstruct contemporary Kin Concealment System,so as to satisfy the demand of establishment of harmonious society. |
