| 摘 要： | 自建国至今，我国农村五保供养法律制度得到不断地完善，对五保对象基本做到了应保尽保，五保供养水平也在不断提高。但是，我国五保供养法律制度还存在着其制度建设不健全、部分地方五供养标准较低、五保供养资金不足，社会捐助不多、敬老院资金缺口大等问题。所以，还应该从不断完善农村五保供养法律体系、不断扩大五保供养资金融资渠道、鼓励多种五保供养方式和加强敬老院的建设和管理等方面努力。

| Abstract: | Since the foundation of the Republic of China, legal system of the rural five guarantees subsistence has been constantly perfect, that is, the targets of five guarantees have got necessary benefits and the standard has increased. But this legal system still has some problems： the unfitness of legal construction, the lower subsistence standard and the lack of subsistence money in some places, the lack of social donation, the large gap of money in seniors＇ caring home, and so on. So it should be improved from some aspects as follow ： firstly, go on perfecting the legal system of the five guarantees subsistence ; enlarging the financing channel of the money ; and encouraging different kinds of ways ; finally, enhancing the construction and management of seniors caring home further more. |
