| 摘 要： | 主要探讨医疗美容损害的确认和鉴定标准,损害赔偿责任和责任竟合制度及损害赔偿范围等法律问题.认为：医疗美容不同于生活美容,也不同于医疗救治;医疗美容损害赔偿是违约责任和侵权责任的竟合,是赔偿请求权的竟合;应建立医疗美容损害的确认制度及鉴定标准;医疗美容损害赔偿范围包括物质损害赔偿和精神损害赔偿.

| Abstract: | A probe into the determination and identification of the injuries incurred by medical cosmetology,injury compensation liability,liability combination system,and the scope of injury compensation is conducted.It is held that medical cosmetology is different from daily cosmetology and medical treatment.It is maintained that the injury compensation incurred by medical cosmetology is the liability combination of contract violation and(customers') right infringement and the combination of appealing for(compensation).It is regarded that the determination system and identification standard of injuries incurred by medical cosmetology should be established and that the scope of compensation for the injuries should cover both material compensation and spiritual compensation. |
