| 摘 要： | 1980年《婚姻法》明确规定了离婚时经济帮助这一救济措施,2001年修订的婚姻法增设了家务劳动补偿与损害赔偿两项救济制度。这三项制度内容抽象,范围过窄,在维护合法权益,保护弱势方、无过错方及受害方利益,彰显公平的价值等方面明显存在不足。其完善:增加损害赔偿的范围,确定经济帮助的标准和适用范围,增加家务补偿的具体内容,扩大权利人的救济范围。

| Abstract: | Marriag Law of 1980 distinctly states economic help as a relief means when divoring.The 2001's revised version of marriage law added domestic labour compensation and damage compensation.The above three means are too general and narrow to represent the fair value.To enlarge the scope of damage compensation,to decide the assissting standard and applying range,to concrete the content of domestic compensation and to expand he relieving scope of the right-subjects are the means to perfect Marriage Law. |
