摘    要:农村宅基地使用权流转和小产权房的蓬勃兴起是一种市场选择。由于价值规律的作用和市场配置生产要素的客观要求,二者存在正相关;由于相关的法律、政策设定的禁区,市场主体在现实生活中就采取多种规避法律的手段,二者又存在着种种负相关。遵循经济规律,是发挥二者正相关的必要条件,完善相关的法律体系,又是弱化二者负相关的法律手段。

Abstract:The transfer of usufruct of rural residence base and the booming of the township property fight house is a kind of market choice. There exist, according to the effect of value law and the objective requirement of the production factors of market allocation, positive correlations. Because of the forbidden area caused by relevant laws and policies, the means of evading law are adopted in daily life. So there also exist negative correlations. Following economic law is the necessary condition to exert positive correlations and perfecting relevant laws is the legal means to weaken negative correlations.
