| 摘 要： | 法治无论是从历史来看，还是从逻辑来看，都是立法、司法、守法三个环节的统一体，而法治的前提是良法。只有符合当时社会最基本的道德要求的法律。才是良法；良法的确立需要民主，需要立法者理性的法律意识；中国的良法是时代精神与中华民族优秀传统的契合。

| Abstract: | Rule of law is the integration of law-making, law executing, justice and law-abiding, either in historical point of view or in logical point of view. The premise of rule of law is honest law. Only the law that is in keeping with the basic morality of the time is honest law; the making of honest law requires democracy and reasonable law idea of law maker; honest law of China is the integration of the spirit of the times and good tradition of the Chinese nation. |
