| 摘 要： | 建筑物致人损害的责任主体是人，而不是物，并且是负有管理义务的人。在司法审判实践中，应区别不同情况来确定建筑物致人损害的责任主体，主要分为管理人有管理义务和管理人无管理义务两种情况。
