| 摘 要： | 自主招生认定书具有何种法律效力,在每年的高校招生工作中都会受到关注和讨论,属于教育法领域的一个新型问题。通过对高校在招生中的法律地位和自主招生法律性质的论证,可以看到,高校在招生工作中履行了特殊行政主体的职能,高校的自主招生具有具体的行政许可性质。因而,自主招生只是单方面的权利授予行为,对考生不具有法律上的强制性。

| Abstract: | What legal effect the confirmation letter of autonomous enrollment of universities has,is receiving far more attention in the university admissions recently,belonging to a new academic problem in the field of higher education. Through the discussion on the legal status and legal nature of the autonomous enrollment in the recruitment of colleges and universities ,we may draw the conclusion that colleges and universities carry out the functions of the special administrative subject in China,and thus autonomous enrollment of university has a specific nature of the legal act as the administrative licensing. Therefore ,merely serving as the granted rights unilaterally for the admitted students, autonomous enrollment does not have any legal compulsory to the examinee at all. |
