| 摘 要： | 尽管保险合同是典型的格式合同,但是却能够极大地促进商事的效率最大化。然而我国保险法并未综合考虑投保人的缔约能力,其是否应当阅读保险条款也未明确规定。作者以为作为保险合同的一方当事人,投保人阅读保险条款应当是其义务,但对于一般投保人和专业投保人来说,阅读保险条款的标准界定应当有所区别。

| Abstract: | Despite the insurance contract is the typical standard form of contract,but it can greatly promote the efficiency of the business.But the contracting ability of the insured is not considered by the insurance law in our coutry,and there is not any terms about whether they should reading clauses.The author thought that insured as one party of insurance contract,should read clauses and it is their obligation,but the standard should be different between genera insured and professional insured. |
