| 摘 要： | 登记作为不动产物权的公示方式已有很久的历史，它起源于近代抵押权与破产法上的登记制度，对整个社会经济发展具有重要的意义。目前，我国不动产登记采登记生效主义，不利于交易安全的保护和公平正义价值的实现。从交易安全和公平的角度，应采登记对抗主义。

| Abstract: | Registration ,which has existed for a long time as a method of public summons on real property right in rem ,originated from the contemporary see also of mortgage and bankrupt law .It is important to the development of overall society and economy. At present ,registration on real property right in rem takes the principle of entry into force after registration ,which is harmful of the protection of the transactional safety and the realization of the fairness and justice value .In the eyes of transactional safety and justice ,we should take the principle of antagonism after registration. |
