| 摘 要： | 公共物权纠纷产生的原因是法律依据不足,在目前《物业管理条例》中有关公共物权管理的条文中缺乏明确的公共物权的界定和具体操作细则,小区公共物权的确认是一大难题;物业管理企业竞争无序,物业管理质量出现趋同化,劣币驱逐了良币;业主自身素质低、收入水平低、消费权利不完整,普遍对业主自治管理缺乏认识,自治能力差,只有加强法制建设、发挥业主委员会的作用、提高业主自身素质才能从根本上解决问题;同时对即将通过的《物权法》中有关公共物权的部分条文提出了自己的见解。

| Abstract: | Reasons for the appearance of dissensions on the ownership of public property mainly include the following aspects: the lack of juristic gist,out-of-order rival ship,and bad autonomic abilities of property owners.How could we solve these problems thoroughly? The countermeasures against these should be that we must strengthen the constructions on legal system,take full advantage of the property owners,committee,and improve the self-diathesis of property owners.And also some different opinions are put forward in this paper on scarcities,existed in the part of the ownership of public property in "the ownership of property law",which will be enacted soon. |
