| 摘 要： | 城乡一体化下农地制度变革的实质是城乡利益的一体化,坚持土地集体所有前提下弱化农地所有权,使集体成为获得固定收益的名义所有者,不再具有对土地占有、使用和处置进行干预的权利,彻底减少其借所有者之名对农地生产经营活动干预的影响。坚持土地集体所有前提下强化和扩大农地使用权,使农民接近事实上的所有权,成为土地的实际拥有者,拥有土地长期稳定的占有、使用和处置权。"弱化农地所有权、强化农地使用权"可顺利推进农地市场化流转与租赁制度改革,使农民在农地制度变革中得到公正的补偿和回报,可改变过去片面强调城市利益、集体利益和国家利益的现象,促进社会主义新农村社会保障体系的建立和完善,协调各方利益关系,构建和谐社会。

| Abstract: | The essence of the innovation on property rights of land for agriculture based on integration between urban and rural is the interest integration. Especially in the course of transferring agricultural land to nonagricultural one, the government should establish and perfect interest share and compensation mechanism, avoiding losses of rural land asset. |
