| 摘 要： | 记者享有采访权,但记者采访权的法律性质并不明确,因而记者在采访活动中的法律地位和权利义务关系也就不可能明确,进而成为记者采访遇阻、遭诉或采访权滥用等现象发生的重要根源。我国应当将记者采访权界定为记者专属享有的职业身份权,其属于私法上的权利,性质为相对权、请求权,其实现和保护遵循“人格权先于身份权”的私法秩序。抽象权利(新闻自由)的私法化保护应当成为我国立法的宏观思维路径。

| Abstract: | Reporters enjoy the right of interview,but the legal nature of the right is not clear,thus the legal status and the right and obligation relations of reporters are also impossible to be identified in interviewing activity,which becomes the root for reporters to suffer obstruction and sues in interview,or leads to the interviewing right abuses.This article points out that the interviewing right should be exclusively enjoyed by reporters for their job identity,which belongs to civil laws,a kind of relative right or right of claim in nature,its realization and protection follows the order of "personality right is prior to identity right".Abstract right(freedom of press) protected by civil laws must become the macroscopic thought in legislation in our country. |
