| 摘 要： | 企业产权制度是决定劳资关系性质的深层根源，劳资关系恶化是古典产权制度的必然产物，而现代产权制度则为劳资关系走向协调提供了良好的制度保障。当前私营企业突出的劳资矛盾，主要根源于不尽合理的古典产权制度，即由所有权单一地决定企业决策的产权安排，企业只追求利润最大化，势必产生严重的劳资矛盾。必须通过改革，建立现代产权制度，确立劳动力产权，让劳动者拥有股权，使职工既作为劳动者又成为资本所有者，并融入公司治理结构中，才能够为构建和谐劳资关系提供坚实的基础。

| Abstract: | The enterprise property right system is the deep - going origin that determines the character of relationship between labor and capital. The classical property right system deteriorates the relationship between labor and capital consequentially, but modern property right system is the institutional guarantee for the industrial harmony. Currently,the prominent contradiction between labor and capital of private enterprises in our nation mainly owns to the classical property right system. According to the system, the arrangement of property right of enterprise＇ s decision - making rests only with the possession of means of production, the property rights structure is single, the only goal of a corporation is the profit maximizing, so that emergence of the severe contradiction between labor and capital is inevitable. In order to changing the state, modern property right system must be founded through reform, labor property right must be estab-lished and let employees possess of share of the corporation. So they can not only be laborers but also the owners of capital and can be put in the corporate governance structure, which will build stable material base for establishing the harmonious relationship between labor and capital. |
