| 摘 要： | 环境行政诉讼的集团诉讼制度是在吸纳了环境行政诉讼和环境民事集团诉讼共同特点的基础上发展起来的。在我国环境行政诉讼发展的过程中,应充分借鉴英美等国的先进经验,改革集团诉讼中的“登记制度”,提倡公益诉讼,以完善在我国实践中应用并不多的环境行政集团诉讼制度。

| Abstract: | With people's paying close attention to the actions of encroaching on environment and with the development of group lawsuit in civil procedural law,the environmental group lawsuit has got a high-speed development in theory and practice.The system of group lawsuit of environment administrative lawsuit is built and developed based on absorbing the character of the environment administration lawsuit and the group lawsuit of civil procedure law.In the process of our country's administration lawsuit of environment,we should absorb fully the advanced experience of Western country,and reform the "register system" in group lawsuit,encouraging the welfare lawsuit,to perfect the system of group lawsuit in environment administration lawsuit,Which is not used to be applied in practice. |
