| 摘 要： | 在买卖合同标的物孳息归属的判断规则上,我国学界有不同的认识。这种认识上的分歧主要是由于我国学界和立法界是在两种不同的意义上使用“交付”一词的结果,我国《合同法》中采取的是“所有权主义”的孽息归属判断规则．而不是“交付主义”。

| Abstract: | At thing judgment rule that fruits belong to that deal contract make, the educational circles of our country has different understanding. The difference that understanding have because of our country educational circle and legislative circle use "hand over" in two kinds of different meanings mainly, what is adopted is the "ownership doctrine" in our country contract law but not "hand over doctrine" . |
