| 摘 要： | 国家公务人员监管不力是近年来特大安全事故发生的重要原因。我国刑法缺乏安全事故中负有直接监督职责的公职人员的责任规定,或者对其处罚有悖罪责刑相适应原则。在厘定公务监督过失的概念及该类犯罪的主体、特征的基础上,分析设立"公务监督过失罪"的现实必要性,进而提出具有建设性的立法建议。
