| 摘 要： | 我国在1982年宪法颁布以前制定的三部宪法均规定了公民"有受教育的权利",但1982年宪法却做出了公民"有受教育的权利和义务"的规定.宪法规定上的上述转变是有着深刻的历史和社会背景的,它涉及到国家利益和公民权利的平衡问题.随着社会历史条件的变化,受教育的法律性质有可能再经历一个由"权利和义务"到权利的转变过程.

| Abstract: | Before the Constitution of 1982,our nation had promulgated three constitutions which prescribed that all citizens "have the right to receive education".But in the Constitution of 1982,a provision was also made that the citizens "have the obligation as well as the right to receive education".What's the specific transition process of the regulations in these constitutions? What's the reason that caused the change? How to realize the tendency for the legal nature of the right of receiving education? The article is trying to do a preliminary study on the questions mentioned above. |
