| 摘 要： | 中国农村土地权利冲突问题实质上是中国政治、经济、法律、社会、道德、习惯等各种力量的冲突,冲突的复杂性造成了中国农村土地使用规则的不确定性。只有建立起农村土地“制度生成”的“公共议论场所”,让各种对立的权利和主张权利的力量和利益充分地博奕,才能从根本上化解权利冲突,生成制度,从而促进制度文明的进步。

| Abstract: | China's rural land right conflicts in the Chinese political, economic, legal, social, moral, customs force to the conflicts, which caused by the complexity of China's rural land-use rules'uncertainty. Only a rural land "system generated" and "public discussion forum" are erected for all the rights and the rights of the opposing forces and interests enter adequately the game, the only way to fundamentally resolve the conflict right is to generate the system, thereby to promote the progress of civilization system. |
