| 摘 要： | 民办高等教育作为我国教育事业的重要组成部分,其在发展过程中因存在法律障碍而面临一些困境。由于国家立法缺陷和实践存在的执法障碍,目前民办高等教育在法律性质定位、税收优惠政策、教师权益保障、学校产权界定及合理回报制度等方面存有发展阻碍。地区间民办高等教育发展的不同现状呼唤尽快出台地方立法,在不违背上位法的前提下,针对现有问题根据本地实际情况制定出行之有效的解决方案。
