| 摘 要： | 破产管理人制度是破产程序进行的必然要求。我国新《企业破产法》的管理人制度存在一定缺陷。完善破产管理人制度,应增设临时管理人,建立破产管理人的市场准入资格管理制度,完善债权人委员会监督机制,明确破产管理人的报酬与责任。

| Abstract: | Bankruptcy administrator system is the inevitable requirement of bankrupt procedures.There exist certain defects in the administrator system of our country's .It is necessary for perfecting bankruptcy administrator system to establish temporary administrators,set up the administrative system for the bankrupt administrator that is permitted into market,perfect the supervisory mechanism of the creditor committee and to define the administrator's remuneration and obligations. |
