| 摘 要： | 表达自由权是公民的一项基本权利，与表达自由相邻接的一个问题即是表达自由权的界限问题．在保障该权利的过程中对其边界进行界定是十分，必要的。基于此，本文拟从表达自由权的概念出发，从该权利性质、功能的角度来探讨表达自由与公共利益、其它基本权利发生冲突时的解决办法，并试图结合我国实际、在参照美国法律相关规定的基础上明晰表达自由权的界限。

| Abstract: | The right to say is one of the very important basic rights,and we usually call it "freedom of speech".The boundaries of the right are closely relative with the right itself.So,it is necessary to define the limits of the right to ensure it comes true.The present endeavor is to begin with examining the conception of the right to say,and clarify its boundaries on the foundation of observation the ways to solve contradictions between the freedom of speech and the public interests and other basic human rights. |
