| 摘 要： | 罪犯基于剥夺政治权利刑而被剥夺的言论、出版等自由不应局限于政治性的范畴。外国人与未成年人客观上都可以适用剥夺政治权利刑,但对未成年适用该刑罚时须格外慎重。缓刑附加剥夺政治权利宜从判决确定之日起执行。

| Abstract: | Criminals’ rights such as freedom of the expression and the press deprived because of the punishment of deprivation of political rights should not be limited in political category.The foreigners and the minors are possible to be deprived political rights,but this punishment should not be applied on minor in general.The enforcement of probation added depriving political rights should start from the day of judgment. |
