| 摘 要： | 商业秘密是竞争情报的一部分,而两者却常被错误地混淆和等同使用。商业秘密和竞争情报存在不完全相同的法律权利属性。对两者的法律属性进行交叉研究和区分,不仅有助于建立和优化健康、公正的市场竞争机制,而且可以有效地促进依法保障正当、合法竞争情报活动。

| Abstract: | Trade secrets is part of competitive intelligence,and both are often mistakenly confused in use.Trade secrets and competitive intelligence are not exactly the same rights of property.The legal cross-study and distinction of the two property should not only to help build and optimize the health and fair market mechanism but also to promote the legal protect on lawful competitive intelligence activities. |
