| 摘 要： | 关于近年来商标权与商号权的冲突问题，寻其本质原因是商号权的相关法律法规缺失和管理机制发展相对落后。如何从立法的角度对商号权加以保护，避免权力冲突，以及在现行立法缺失的情况下如何进行司法救济，是问题的关键。文章重点从这两个方面进行阐述，提出完善商号立法以及加强司法救济的相关建议。

| Abstract: | The conflict cases between the brand name and firm in recent years is mainly because of the law inadequacy and the backward management. The key to this problem lies in how to protect the firm with legislation to avoid conflicts. The paper,based on the two aspects, proposes the way improving firm legislation and judicial protection. |
