| 摘 要： | 环境刑法应当也可以设立过失危险犯。环境法益的特点和过失危险犯的价值、环境过失危险行为所具有的严重的社会危害性、我国环境法益保护的迫切现实需要决定了应当设立过失危险犯。由于过失危险犯与刑法的谦抑性原则、被允许的危险理论以及我国刑法的规定均不违背,从而决定了过失危险犯设立的可行性。环境刑法设立过失危险犯时要限制过失危险犯成立的范围;要合理的配置刑罚;要采用恰当的立法模式。

| Abstract: | Environmental criminal law can and should include negligent dangerous crime.The characteristics of environmental legal benefit,the importance of negligent dangerous crime,the serious social harm of negligent dangerous act and the urgency of protecting the environmental benefit in our country have jointly decided that negligent dangerous crime should be included in the environmental criminal law.Since negligent dangerous crime is not against the restraining principle of criminal law,or the permitted risk theories or the provisions of the criminal law,its inclusion in the environmental criminal law is feasible.If negligent dangerous crime is to be included,its guilty range should be limited with reasonable punishment and legislative model. |
