| 摘 要： | 从反倾销的实践看,要打赢官司获得外贸的实际拓展,既要有宏观的战略性考虑,又要有微观的应对措施,政府部门、行业协会、企业必须紧密配合,协同行动。一是要充分利用WTO的贸易争端解决机构。二是切实改进政府的职能。政府应通过各种媒体和方式普及WTO的基本知识,加强对出口企业落实“谁应诉、谁受益”的政策。必要时要积极协助涉案企业,为其提供相关资料,使应诉企业相对主动。三是要在反倾销调查当局不承认我国为市场经济地位情况下,力争使其认定具体企业是在市场经济体制下运作。四是建立一批真正的行业协会,在企业和政府之间架起一座能够迅速传递信息的桥梁。

| Abstract: | We must have both macro strategies and micro countermeasures gaining the lawsuit to achieve the practical trade expansion from the practice of anti-dumping, governmental departments, industrial societies and enterprises must cooperate close and team act. Firstly, we should make full use of the institutions of solving the disputes of trading on WTO. Secondly, we should improve governmental functions in real earnest. The government should popularize the basic knowledge on WTO by means of various Medias, carrying out the policy of "those persons who reply the lawsuit will benefit". We should actively help the enterprises involved in cases and provide information concerned if necessary, so as to have the enterprise which reply the lawsuit try to gain the initiative. Thirdly, we should try our best to make the anti-dumping investigation authority firm believe that specific enterprises operate under the market economy system if it doesn't admit the market economy position of China. Fourthly, we should set up a batch of real industrial societies and put up a bridge which can rapidly deliver information between the government and the enterprises. |
