| 摘 要： | 随着被害人救助制度建立这一问题被社会所关注.作为其一个重要部分的精神损害赔偿亦应在其中有所体现.相关的法律制度也应与其保持统一.在对刑事罪犯人权保护的同时.刑事犯罪所具有的公权性质如何去平等地保护私权下的被害人所受的精神损害则是学界一直予以关注的问题.通过对刑事附带民事诉讼中精神损害赔偿制度的建立.以期促进刑事制度与被害人救助制度间的和谐.

| Abstract: | The relief system for victim has been paid great attention to since its establishment.As an important part of the system,mental damages should be demonstrated,and the other legal systems concerned should also comply with it.It is a hot topic in the academic world that how to protect the mental injury of the victim under the private right system equally by using the public right system of criminal offence.The authors argue that the mental damages should be confirmed in civil suit collateral to criminal proceedings through their study in the paper,so as to improve the harmony between the criminal system and the relief for the injured. |
