| 摘 要： | 我国现行的刑事实体法和程序法对刑事附带民事诉讼中的精神损害赔偿均未做具体规定。这背离了确定刑事附带民事诉讼制度的立法初衷，对刑事犯罪的被害人也有失公平。文章试图分析刑事附带民事诉讼中精神损害赔偿的意义，并提出相应的对策，以期实现公平正义的法律目的。

| Abstract: | Current criminal law and procedure law is lack of detailed spiritual damage compensation in criminal case appending civil lawsuit, which deviates from the legislature intention in defining the system, and is unfair to the crime victim. The writer attempts to analyze the significance of the spiritual damage compensation with corresponding solutions to realize justice. |
