| 摘 要： | 票据保证和民法上的保证既有联系又有区别。票据保证既有从属性,又有独立性,其独立性强于从属性,是相对独立的票据行为,这直接影响到票据保证的效力。理解票据保证两种属性关系的定位,对我们解决实际问题是很有益处的。

| Abstract: | Relations and differences exist between guarantee of bills and guarantee of the civil law.The guarantee of bills has both subordinate and independence,and independence has advantages over subordinate.It is a comparatively independent act on commercial paper and has a direct influence on effectiveness of guarantee of bills.How to understand orientation of the two subordinates will do good in solving practical problems. |
