关于我国公立义务教育学校法律地位的探讨

摘    要:我国公立义务教育学校不是法人,这是由义务教育的特点和性质决定的。不赋予学校法人地位,是确保义务教育学校均衡发展的必要条件,是更好地贯彻国家教育方针的必要措施。公立义务教育学校不以其财产独立承担民事责任。世界上大部分国家和地区的公立义务教育学校都不是法人。由于我国尚未建立起比较完善的公共财政制度和比较规范的政府预算制度,目前我国公立学校也不具备成为法人的外部制度环境。

Investigating the Legal Status of Public Schools for Compulsory Education in China

Abstract:In China, public schools for compulsory education are not juridical persons, which is determined by the nature and features of compulsory education. Balanced development of the public school is guaranteed only if the public school is not endowed with the legal status of a juridical person. This ensures the smooth implementation of China's educational policies. The public school is prohibited from bearing civil liability using its property independently. In most countries and regions, the public school is not a juridical person. Now our country is lacking in an external legal environment that facilitates turning the public school into a juridical person, mainly due to the imperfect public finance system and governmental budgeting system.
