| 摘 要： | 民间借贷作为民间剩余资本的一种投资运行方式,对市场经济特别是非公有制经济的发展起着不可替代的作用。然而,目前,我国并未有统一明确的法律体系对民间借贷进行规制。同时,民间借贷与非法集资犯罪行为之间也存在着模糊地带。因此,我们必须用理性、发展的眼光看待民间借贷,理清民间借贷与非法集资行为之间的界限,进一步完善法律法规,引导民间借贷健康有序发展。

| Abstract: | As an investment operation mode of the surplus civil capital, the private lending plays an irreplaceable role in the development of the market economy, in particular, the non-public sectors of the economy. However, currently there has been no consistent and specific legal system to govern the private lending. Besides, the distinction between the private lending and the illegal fund-raising crime is rather ambiguous. So it is necessary for us to deal with the private lending reasonably and in far-sighted way by distinguishing the difference between the private lending and the illegal fund-raising crime, and perfecting the laws and regulations, in order to guarantee the development of the private lending in a healthy and ordered way. |
