| 摘 要： | 共享经济带来的新业态使传统劳动力与生产资料组织方式发生改变,由于缺乏明确法律规定,网约车平台是否存在劳动关系难以认定,司机的劳动权益易受侵害。尽管生产要素的组织方式发生改变,但劳动关系本质未发生改变。通过社会加盟车辆模式下的案例分析,不同法院对从属性判定标准存在差异,需要进一步探讨与反思从属性内涵以及当下的判定标准。劳动法律制度架构应当做出相应革新,对提供劳务者适当倾斜保护;丰富判定指标,建立决定性标准和辅助性标准;淡化人格从属性,重视经济从属性和组织从属性。

| Abstract: | The sharing economy has changed the organization between the traditional labor force and the means of production.Due to the lack of clear legal provisions,it is difficult to determine whether the labor relationship exists between the network car and the platform.The legitimate rights and interests of network drivers are vulnerable to infringement.Although the organization of the factors of production has changed,the essence of labor relations has not changed.Through the case analysis under the mode of social franchised vehicles,we find that different courts have different judgment standards of subordination,so we need to further explore and reflect on the connotation of subordination and the current judgment standards.The structure of the Labor Law System should be innovated.The workers should be properly protected.The judgment indicators should be enriched.The decisive and auxiliary standards should be established.The personality dependency should be weakened and the economic dependency and organizational dependency should be emphasized. |
