对我国劳动争议处理方式的利弊分析及思考

摘    要:现行法律为发生劳动争议的当事人提供了解决纠纷的手段,而在实践中这些法律手段并没有完全将其作用发挥到极致。通过对现行劳动争议处理方法的利弊分析,结合工业发达国家的处理劳动争议的方法,认为不能对现行的劳动争议方法予以全面否定,需要在现有劳动争议处理方法的基础上,依据我国经济建设的实际分阶段地对其进行完善与重构。

Abstract:The laws at the present have provided legal means to settling labour disputes for the parts in question.In reality,however,these laws as the means do not fulfill their functions to the most.This article,referring to the practices in the field in the developed industrial countries,analyzes the pros and cons of these means in practice,arguing that the present way of settling labour disputes should by no means be denied completely,it should instead be reformed and improved to the perfect by phase correspondent to the situation of the economical construction of China.
