| 摘 要： | 金融专利是金融创新的重要保护手段，是金融竞争的重要战略储备。本文系统回顾了中外金融专利的文献，在已有三类研究视角的基础上提出了情报信息视角的新观点，并以此界定了金融专利的研究范畴。本文还总结了美国、欧洲和中国的金融专利在近20年快速发展过程中呈现的主要特征，梳理了金融专利国际比较研究的成果，明晰了金融专利法律风险的特征和原因，归纳了中国可以采取的金融专利战略。文章最后提炼了金融专利研究中亟待解决的问题，构建了金融专利基础研究框架，同时还指出应加强金融专利的作用机制和风险管理研究。

The Retrospect and Prospect of Financial Patent Research |

| Abstract: | Financial patents are an important means of protection for financial innovation and an important strategic reserve for financial competition. This paper systematically reviews the literature of financial patents at home and abroad, and puts forward a new perspective of intelligence information based on the existing three types of research perspectives, and thus defines the scope of financial patent research. This article also summarizes the main characteristics of financial patents in the United States, Europe, and China during the rapid development of the past 20 years, sorts out the results of international comparative studies on financial patents, clarifies the characteristics and causes of financial patent legal risks, and summarizes financial patent strategies China may adopt. At the end of the article, important issues to be solved in the field of financial patent research are refined, and a basic research framework for financial patents is constructed. At the same time, it also points out that empirical research on the mechanism of financial patents and financial risk management research should be strengthened. |
