| 摘 要： | 笔者从产权激励角度论述了专利制度对技术创新绩效的影响,并提出假设：只有温和的专利制度,才会带来技术的创新激励。通过随机前沿模型对1987-2010年我国技术创新绩效进行测量,发现技术创新绩效的波动和专利制度的变动存在波动相关性,然后采用三次函数的库兹涅茨曲线模型,选择专利保护程度作为衡量产权激励度的指标进行实证分析,得出结论：现阶段我国的专利制度对于技术创新绩效的产权激励作用存在＂倒U＂型关系,政府应采取温和的专利保护制度。

| Abstract: | This paper is done to sort out influence on technology innovation performance exerted by patent system in perspective of the property rights incentive,which is founded on the hypothesis： only moderate patent system can bring about the technology innovation incentive.Relationships are discovered between innovation performance fluctuations and the patent system changes through technical innovation performance measurement between 1987-2010.Then on the basis of ＂ Environmental Kuznets Curve ＂ model and the analysis patent protection degree,the following empirical conclusion can be achieved： At the present stage of our patent system,the technology innovation performance and the property rights incentive effect are in the inverted ＂U＂ type relationship,moderate patent system should be carried out by the government. |
