| 摘 要： | 亚氏《政治学》中的法哲学思想是他《政治学》中思想内容中的一个重要组成部分,并且与城邦政体论述内容密不可分。亚氏的法哲学思想不是凭空得出来的,他一方面继承和发展了以前政治思想家关于法治方面的思想,另一方面认真考察城邦与政体中的法律和法治实践经验,通过比较和鉴别而得出,也就是说具有深厚的经验基础。因此,亚氏的法治思想是理论性与经验性、实证性与现实性、道德性和法律性的统一。
