| 摘 要： | 水权转让是实现水资源优化配置的有效方式之一。水权转让是一种法律行为,其客体水权是一种新型的用益物权,又是具有公权性的私权,同时具有外部性的特征。被转让水权应符合权利转让的要件,为生态环境分配的水权及法律有禁止性规定的水权不得转让。

| Abstract: | The transfer of water rights is one of the efficient ways of allocating water resources.It is a legal act.The object,water rights,is a new use right as well as a private right with some public right features thus containing external features.The transferred water rights should meet the basic requirements of right transfer.The right of the water which is allocated for the protection of environment and which law prohibits from being transferred can not be transferred. |
