| 摘 要： | 跨国代孕问题中本国法院往往以外国裁判违反法院地国的公共秩序为由,拒绝承认外国法院承认父母子女身份的判决。这种做法有滥用“公共秩序保留”制度的嫌疑,也不符合“最大保护儿童利益”的要求。因此,应当在跨国代孕问题中对公共秩序的适用予以限制;同时,应当对意愿父母的资质进行审查并严厉禁止商业代孕行为。

| Abstract: | In terms of the transnational surrogacy,the courts often refuse to recognize the foreign judgments on parental power between surrogate children and intended parents,excusing for that these judgments damage the public order in receiving country.Such a practice abuses the principle of reservation of public order and harms the best interests of surrogate children.Therefore,the principle of reservation of public order should be limited in transnational surrogacy.Also,it is suggested to investigate qualifications of intended parents and prohibit commercial surrogacy strictly. |
