| 摘 要： | 我国传统刑法理论中关于违法性错误的解释,有值得反思之处。违法性认识属于故意的要件。行为欠缺违法性认识,在有违法性可能且法律有关于处罚该过失犯罪的规定时,应作过失犯罪论处;在法律无处罚此项过失犯罪规定以及行为人无认识违法性之可能时,应作无罪处理。

| Abstract: | In our traditional criminal law theory,it is still necessary for us to rethink about the theory of the fault on the illegality. Fault on the illegality is regarded as a subjective element. The act without the fault on the illegality should be held as a delinquency act when the person has been conscious of the possibility of the illegality and such an act is provided and penalized in the criminal law. Without such criminal provisions and the possibility of consciousness of illegality ,such an act should be judged not guilty. |
