摘    要:劳动合同是劳动者和用人单位确立劳动关系、明确双方权利和义务的协议,是维护劳动合同当事人合法权益的重要法律保障形式。劳动合同的解除制度作为劳动合同的重要组成部分,对劳动者与用人单位双方当事人的利益影响重大。我国应借鉴国外劳动立法的成功经验,结合我国司法实践和劳动力市场状况,对我国《劳动法》第31条的法律性质、劳动者单方解除劳动合同与违约责任问题、用人单位的利益保护及预告期长短等问题进行研究和改进。

Abstract:Labor contract is the treaty which is made by labors and working units in order to set up the working relation and confirm the right and obligation between the two sides. It is also the important safeguarding way to defend the workers rights. The absolution system is an important part in labor contract. It greatly influences the interest of the two sides. Now, we attempt to analyze the 31st item in Labor Law from the following aspects: the quality in law, the problem caused by one side who break the contract, the safeguard of working units interest and the tines of prediction.
